1. Acceptance of Terms

By accessing and using Presto Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Service Description

Presto Service is a platform that connects clients with qualified professionals across various fields (medical, wellness, law, finance, real estate, technology, and more). We also provide an AI advisor for instant guidance, appointment booking, in-app messaging, and recurring appointment management.

3. User Accounts

To use certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account information
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Professional Services & Subscriptions

Professionals on our platform are independent service providers. Presto Service facilitates connections but is not responsible for the quality, safety, or legality of services provided. Professionals may subscribe to premium plans to access advanced features such as increased visibility and enhanced management tools.

5. Payments, Platform Fees, Promotions & Refunds

Payments are processed securely through Stripe. The following terms govern commissions, promotional campaigns, processing fees, refunds, and the appointment completion flow.

5.1 Commission Structure

Presto Service charges a commission on each completed appointment. The applicable commission rate is determined at the time an appointment is marked complete and is based on the professional's active promotional enrollment (if any); otherwise the standard commission rate applies. The effective rate applied to each transaction is recorded on the appointment and visible in the professional's dashboard.

5.2 Promotional Campaigns (Including the Founders Program)

From time to time, Presto Service runs promotional campaigns — such as the Founders Program — that offer enrolled professionals a reduced (or waived) commission rate for a limited period. Each campaign defines:

  • Promotional commission rate — the reduced commission percentage applied during the promotional period.
  • Promotional period — the length of time the reduced rate applies, starting from enrollment.
  • Eligible booking threshold — the cumulative dollar value of completed appointments at which the promotion ends and the standard commission rate resumes.
  • Maximum commission credit — the total commission dollars that may be waived per professional under the campaign.
  • Priority placement duration — the period during which the professional receives priority visibility in the marketplace.
  • Giveaway eligibility — whether enrollment qualifies the professional for launch giveaways.

A promotion ends automatically on the earliest of: (a) the promotional period expiring, (b) the professional reaching the eligible booking threshold, or (c) the maximum commission credit being consumed. Once the promotion ends, the standard commission rate applies to all subsequent appointments. Eligibility for a campaign is determined by the campaign's category and region rules and is granted at Presto Service's discretion.

5.3 Processing Fees & Fee Allocation

Stripe charges a non-refundable processing fee on every transaction. Presto Service does not absorb these fees. Fee allocation follows a "platform-never-pays" model:

  • Completed appointments: the processing fee is deducted from the professional's payout.
  • Cancellations: if a client cancels within the free cancellation window, the client receives a full refund and is not charged the processing fee. If the professional initiates the cancellation or is otherwise at fault, the non-recoverable processing fee is charged to the professional.
  • Disputes and chargebacks: non-recoverable processing and chargeback fees are charged to the party determined to be at fault by Presto Service.
  • Fees charged to a professional that cannot be recovered from a pending payout are recorded as a fee liability and deducted from future payouts.

5.4 Appointment Completion & Confirmation

When a professional marks an appointment as complete, the appointment enters a "pending confirmation" state. The client then has 72 hours to either confirm the completion or open a dispute. If the client takes no action within 72 hours, the appointment is automatically confirmed and the payout is released on the standard payout schedule. Commission and promotional allowances are calculated and consumed at the moment the appointment is marked complete.

5.5 Cancellation & Refund Policy

  • Flexible cancellation: Full refund if cancelled at least 24 hours before the appointment.
  • Partial refund: Some professionals offer a 50% refund for cancellations made within 24 hours of booking.
  • Non-refundable: Some professionals do not offer refunds after 24 hours of booking.
  • The applicable cancellation policy is clearly displayed on each professional's profile before booking confirmation.
  • Approved refunds are returned to the client's original payment method. Promotional allowances consumed by a refunded appointment are restored to the professional's campaign balance where applicable.

6. Recurring Appointments

The platform supports recurring appointments (weekly, bi-weekly, or monthly). Recurring payments are managed through Stripe. Cancellation of a recurring series must be made before the next scheduled session to avoid additional charges.

7. Disputes & Resolution

In the event of a dispute regarding an appointment or payment, users may submit a claim through our integrated dispute management system within 72 hours of the appointment being marked complete. Presto Service will review each case and render a decision within a reasonable timeframe.

Dispute resolutions may include a full refund to the client, a partial refund, full payment to the professional, or no action. Non-recoverable Stripe processing and chargeback fees are charged to the party determined to be at fault. Presto Service's decisions are final with respect to dispute-related refunds and fee allocation.

8. Tax Reporting

Presto Service collects and retains transactional data for tax compliance purposes. Professionals are solely responsible for reporting their income in accordance with applicable tax laws. Revenue reports are available in the administrative dashboard for reference purposes.

9. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm other users
  • Provide false or misleading information
  • Use the platform for unauthorized purposes

10. Intellectual Property

All content on the platform, including text, graphics, logos, and software, is owned by Presto Service and protected by intellectual property laws.

11. Limitation of Liability

Presto Service shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting on the platform.
